For the purpose of this agreement, stated “farm animal(s)” will be used throughout this document to encompass all of the animals guests of the Farm Sanctuary may encounter, including, but not limited to: guinea pigs, rabbits, chickens/roosters, guinea fowl, peacock/peahen, ducks, pigs, miniature horses, horses, miniature donkeys, donkeys, miniature mules, mules, llamas, alpacas, cows, emus, rheas, goats, sheep, dogs, zebras/zebra hybrids, camels.

I undersigned for myself and/or all minors in my have read & understand, & freely and voluntarily enter into this Release Hold Harmless Agreement with American Made Miniatures Farm Sanctuary, understanding that this Release & Hold Harmless Agreement is a waiver of any & all liability (ies). I have also read, understand and agree to all rules established by American Made Miniatures Farm Sanctuary & its owners, agents, employees, and/or successors. I am aware and agree that it is my responsibility to make every guest I bring to the farm sanctuary aware of the rules and have them sign a Release & Hold Harmless Agreement. I am aware that interacting with farm animals while on the sanctuary property, constitutes risk to the participants, & that such activities involve inherent risks & dangers, including serious injury or death. I am aware that this is both a working ranch and a private home located in a rural location. I am solely responsible for my own safety and the safety of my guests. INTERACT AT YOUR OWN RISK. There is no spectator area, by your presence on these grounds you will be regarded as a participant and you have indicated that you have accepted the limits of liability resulting from the inherent risks of farm animal activities.               

I understand the unpredictability and potentially dangerous character of farm animals generally; and I understand that the use, or handling of a farm animal always involves a risk of bodily injury to anyone who handles farm animals, as well as the risk of damaging the property of others. I understand that any farm animal, irrespective of its training and usual past behavior and characteristics, may act or react unpredictable at times, based upon instinct or fright, which, likewise, is an inherent risk assumed by me when I am handling a farm animal. Any and all farm animal related activities can be cause serious injury, bodily harm and/or death.  I voluntarily and freely choose to incur such risk or risks and the dangers involved and resulting.  

I understand the potential dangers that I could incur in interacting with, grooming, handling, or feeding said farm animal; including, but not limited to, any interactions with other animals. Understanding those risks I hereby release that company, its officers, directors, shareholders, employees & anyone else directly or indirectly connected with that company from any liability whatsoever in the event of injury or damage of any nature (or perhaps even death) to me or anyone else caused by or incidental to my electing interact with any farm animal. I understand that is an outdoor activity, germs are present in any nature type setting. It is the responsibility of the guest to ensure that they (and those in their party) do not put their hands in their mouth, wash their hands as needed, & apply hand sanitizer. 

I understand & recognize and warrant that this Release & Hold Harmless Agreement, is being voluntarily & intentionally signed & agreed to, & that in signing this Release & Hold Harmless Agreement I know & understand that this Release & Hold Harmless Agreement may further limit the liability of farm animal professionals to include any activity, whatsoever, involving farm animal skills as to relieve, release & hold harmless said equine professional(s) from any continuing duty to monitor my farm animal activities.  I recognize and agree that I know which farm animal professional(s) I will be working with, and acknowledge that I agree said farm animal professional(s) has/have made reasonable and prudent efforts to determine my ability to engage in the farm animal activity, and has/have sufficient knowledge of my farm animal skills as to relieve, release and hold harmless said equine professional(s) from any continuing duty to monitor my farm animal activities.  

I further voluntarily agree to warrant to Release & Hold Harmless this (these) farm animal professional(s) from any liability whatsoever, including, but not limited to, any incident caused by or related to said equine professional’s(s’) negligence, relating to injuries known, unknown, or otherwise not herein disclosed; including, but not limited to, injuries, death or property damage from: walking, grooming, feeding, touching farm animals; use of the barn, paddock, walking paths, picnic tables, in any capacity; or my failure to understand any farm animal professional’s directions relating to any an all interactions with farm animals.               

I release American Made Miniatures Farm Sanctuary , its owners, agents, employees, successors from any and all liability, claims, demands, actions, and causes to action whatsoever arising out of any damages, both in law and in equity in any way resulting from personal damage sustained by me arising out of interacting with farm animals, or using the facilities.  I expressly waive all claims that I may have against American Made Miniatures Farm Sanctuary and it affiliates for each and all the foregoing. The foregoing RELEASE by me from liability includes any losses, damages or injuries resulting to me or any minor for whom I’ve RELEASED (by signing this form), from the negligence of American Made Miniatures Farm Sanctuary or their agents and from any negligent cause controlled by any of them.  MEDIA RELEASE: I hereby consent that any photographs &/or video recordings taken by American Made Miniatures Farm Sanctuary , its owners, agents, employees, &/or successor are the property of American Made Miniatures Farm Sanctuary  & they shall have the right to duplicate, publish, distribute, sell, reproduce & make other uses of such media as they may desire, free & clear of any claim whatsoever. 

JURISDICTION:  This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the State of California and no other jurisdiction.  Any litigation involving the parties to this Agreement shall be brought solely within the State of California and shall be within the jurisdiction of its Courts. Person voluntarily entering into this Release & Hold Harmless Agreement.
